Assisted Move service

This service is subject to the following conditions:

1. The Service is only available on selected Cala homes at Cala’s discretion. Cala has the right to refuse your application for the Service at any point prior to your reservation of the Cala Home if we learn of any reason that your Existing Property is not suitable for the Service.
2. An Assisted Move reservation of the Cala Home will only be considered by Cala if we believe that the sale of your Existing Property can be easily managed from a Cala regional office (of which Cala shall be the sole judge).
3. The Service cannot be used with any other incentives or purchase services unless specifically agreed by Cala
   in writing at the time of reservation

Once your formal reservation of the Cala Home is taken and the reservation fee is paid by you, the following steps will take place and you agree to use all reasonable endeavours to ensure these are progressed as quickly as reasonably practicable:

1. The Cala Home will be removed from the market.
2. You authorise Cala to release the relevant details to the Recommended Estate Agent and any other third parties necessary for the purposes of facilitating the marketing of the Existing Property.
3. The Recommended Estate Agent will be appointed (either by you or by Cala on your behalf). Your Existing Property must be on the market within ten days of your reservation date of the Cala Home. The Recommended Estate Agent will:
   1. market your Existing Property at the Agreed List Price;
   2. arrange viewings by appointment, at mutually convenient times; and
   3. sell your Existing Property for no less than the Minimum Acceptance Price
4. If there is any unreasonable delay by you in appointing the Recommended Estate Agent to market the Existing Property (of which Cala shall be the sole judge), Cala reserves the right to withdraw the Existing Property from the Assisted Move Service and cancel the reservation of the Cala Home.
5. You agree not to instruct any other agent in respect of the Existing Property until the Assisted Move Expiry Date passes.
6. You agree to your Existing Property being marketed until the Assisted Move Expiry Date passes or until you accept an offer of at least the Minimum Acceptance Price, whichever is the earlier.
7. Cala’s solicitor will issue your solicitor with a draft formal offer in respect of the Cala Home and a signed copy of these Terms. You must liaise with your solicitor to ensure that you are comfortable with the terms of the offer for the Cala Home prior to the Assisted Move Expiry Date.
8. You agree to present your Existing Property to viewers in a neat and tidy condition.
9. Cala will appoint a surveyor to survey your Existing Property. Cala will pay the surveyor fees directly.
10. If your Existing Property has any external cladding (full or partial including balconies) and is over 18m in height (usually 6 storeys high) we will require a copy of EWS1 form. If there is not valid EWS1 certificate currently in place, a qualified professional would be required to conduct a fire-risk appraisal of the external wall system, and/or cladding. Please note that an acceptable rating for the EWS1 certificate would be A1, A2 or B1. In this situation, you should instruct your solicitor as soon as possible to ensure that they are able to obtain the required documentation in terms of the contract.
11. You agree to have any works required by the said Survey undertaken at your cost within a mutually agreed timescale, if required by Cala.
12. You agree to accept a reasonable offer for the Existing Property at the earliest opportunity which shall not be less than the Minimum Acceptance Price.
13. If the highest offer received for your Existing Property after 28 days of your Existing Property first being marketed by the estate agent meets the Minimum Acceptance Price, this offer will be accepted by you.
14. The prospective purchaser of the Existing Property must exchange contracts with you for the purchase of the Existing Property within 28 days from the date of their offer being accepted. If the contracts are not exchanged within this period, Cala may consider an extension, however Cala reserves the right to withdraw the Existing Property from the Assisted Move Service, cancel the reservation of the Cala Home and re-market the Cala Home.
15. Provided the provisions of these Terms are met by you, Cala will pay, direct to the Recommended Estate Agent, the fees in relation to the marketing of the Existing Property.
16. If a suitable purchaser is not found by the Assisted Move Expiry Date, Cala will:
    1. consider any request by you to extend the Assisted Move Expiry Date; or
    2. cancel your reservation of the Cala Home.
17. If you withdraw the Existing Property from the Assisted Move Service before the expiry of the Assisted Move Expiry Date, Cala reserves the right to cancel the reservation of the Cala Home and to re-market the Cala Home.
18. Cala may, at its sole discretion, agree to exchange contracts with you for the Cala Home before you exchange contracts for the sale of your Existing Property. If we agreed this, the contract for the Cala Home must allow for termination of the contracts for the Cala Home in line with Clauses 4, 14 and 17 of this offer letter.

4. If there is any unreasonable delay by you in appointing the Recommended Estate Agent to market the Existing Property (of which Cala shall be the sole judge), Cala reserves the right to withdraw the Existing Property from the Assisted Move Service and cancel the reservation of the Cala Home.

10. You will require to fill out the Property Questionnaire to be included in the Home Report honestly and accurately and you agree to give as much information as you are able when answering questions about the Property.
11. If the Home Report reports your Existing Property has any external cladding (full or partial including balconies) and is over 18m in height (usually 6 storeys high) we will require a copy of EWS1 form. If there is not valid EWS1 certificate currently in place, a qualified professional would be required to conduct a fire-risk appraisal of the external wall system, and/or cladding. Please note that an acceptable rating for the EWS1 certificate would be A1, A2 or B1. In this situation, you should instruct your solicitor as soon as possible to ensure that they are able to obtain the required documentation in terms of the missives.
12. You agree to have any works required by the said Home Report undertaken at your cost within a mutually agreed timescale, if required by Cala.
13. You agree to accept a reasonable offer for the Existing Property at the earliest opportunity which shall not be less than the Minimum Acceptance Price. If the highest offer received for your Existing Property after 28 days of your Existing Property first being marketed by the estate agent meets the Minimum Acceptance Price, this offer will be accepted by you.
14. The prospective purchaser of the Existing Property must conclude missives with you for the purchase of the Existing Property within 28 days from the date of their offer being accepted. If the missives are not concluded within this period, Cala may consider an extension, however Cala reserves the right to withdraw the Existing Property from the Assisted Move Service, cancel the reservation of the Cala Home and re-market the Cala Home.
15. Provided that the provisions of these Terms are met by you, Cala will pay, direct to the Recommended Estate Agent, the fees in relation to the marketing of the Existing Property.

    2. cancel your reservation of the Cala Home.

18. Cala may, at its sole discretion, agree to conclude missives with you for the Cala Home before you conclude missives for the sale of your Existing Property. If we agreed this, the contract for the Cala Home must allow for termination of the contracts for the Cala Home in line with Clauses 4, 14 and 17 of this offer letter.
