PART EXCHANGE SERVICE

Part Exchange will be considered subject to CALA’s purchasing criteria, terms and conditions. We have the right to refuse your application for the Part Exchange service but if this happens our Sales Advisor will be pleased to work with your selling agents, recommend alternative selling agents or help you with other suggestions about how to market your existing home to help you to find a quick sale. To determine a fair price to offer for your existing home, CALA will obtain two independent valuations based on achieving a sale in a six week period. We will not base our offer on historic valuations or offers and our offer is valid for seven days only. We will carry out a survey on your existing home after you accept an offer. The part exchange sale depends on the results of that survey. In the event that the survey reveals problems with your existing home we will talk to you to find a solution, however if we fail to agree terms, we will deduct any cost incurred by CALA for the survey and specialists reports when we return your reservation fee. While your new home is being built you will have to allow us to market your home and arrange viewings by appointment, at reasonable times. You cannot use the service with any other incentives or purchase services unless we specifically agree you can at the time you reserve your home.

OUR PURCHASING CRITERIA

Where a part exchange sale is being considered: 

CALA will only accept part exchange in the absence of a cash purchaser

There must be sufficient differential between the value of your existing home and the CALA home and market demand/sales potential for us to consider part exchange

Geographically, CALA will only consider part exchange on a property that can be easily managed from a regional office location

 

GUARANTEED BUYER

The Guaranteed Buyer service will be considered subject to CALA’s purchasing criteria, terms and conditions. We have the right to refuse your application for the Guaranteed Buyer service. To determine a fair price to offer for your existing home, CALA will obtain two independent valuations based on achieving a sale in a four to eight week period and our offer will be based on those valuations. If the valuations are very different, we will consult with a surveyor or other expert in property valuations. If your home has not had a recent home report on it, we will carry out a survey on your existing home after you accept an offer. The Guaranteed Buyer sale depends on the results of that survey. In the event that the survey reveals problems with your existing home we will talk to you to find a solution, however if we fail to agree terms, we will deduct any cost incurred by CALA for the survey and specialists reports when we return your reservation fee. While your new home is being built you will need to keep us updated as to how your sale is progressing. You cannot use the service with any other incentives or purchase services unless we specifically agree you can at the time you reserve your home.

OUR PURCHASING CRITERIA

5% DEPOSIT CONTRIBUTION

Deposit contribution paid offer is available on selected plots only and may be time limited. Where exact values are stated, these are based on a purchase at full asking price. Some lenders may not accept deposit contributions from housebuilders. This offer cannot be used in conjunction with any other offer unless agreed by CALA at time of reservation.

 

FIRST HOME FUND

YOUR HOME MAY BE REPOSSESSED IF YOU DO NOT KEEP UP REPAYMENTS ON A MORTGAGE OR ANY OTHER DEBT SECURED ON IT.

A second charge over your home is required. The First Home Fund cannot be used in conjunction with part exchange or any Scottish Government shared equity schemes (e.g. Help to Buy (Scotland) Affordable New Build, Help to Buy (Scotland) Smaller Developer, New Supply Shared Equity or Open Market Shared Equity). 

Availability of other incentives/offers subject to lenders criteria and CALA’s discretion. Your mortgage lender’s deposit requirements may vary, but you should usually expect to contribute a deposit of at least 5% of the purchase price. Available on selected properties, and subject to the Government’s specific terms, conditions and qualifying criteria. 0% APR typical.

STAMP DUTY PAID 

Stamp duty paid or contribution offers are available on selected plots only and may be time limited. Where exact values are stated, these are based on a purchase at full asking price. Unless otherwise stated, the offer of full stamp duty paid is for first home stamp duty only. If the CALA home purchased is not your only home, you will need to cover the additional stamp duty incurred. Contact the Sales Advisor at the participating development for details of the applicable plots and the latest reservation date and legal completion date to which this offer can apply. This offer is only available in conjunction with any other offer at the sole discretion of CALA Homes. 

 

LBTT PAID 

LBTT paid or contribution offers are available on selected plots only and are time limited. Where exact values are stated, these are based on a purchase at full asking price. Unless otherwise stated, the offer of full LBTT paid is for first home stamp duty only. If the CALA home purchased is not your only home, you will need to cover the additional LBTT incurred. Contact the Sales Advisor at the participating development for details of the applicable plots and the latest reservation date and legal completion date to which this offer can apply. This offer is only available in conjunction with any other offer at the sole discretion of CALA Homes. Payment of LBTT is made via appropriate value deduction on final statement of sale, not direct to the collecting authority.  

 

DEPOSIT/LEGAL FEES PAID 

Incentives are available on selected plots only. Deposit/legal fees are paid up to a specific maximum value, dependent on the plot-specific offer. Contact the Sales Advisor at the participating development for details of the applicable plots and the latest reservation date and legal completion date to which this offer can apply. This offer is only available in conjunction with any other offer at the sole discretion of CALA Homes.   

 

VOUCHER/LEAFLET BASED OFFER 

Incentives are available on selected plots only. Incentives are paid up to a specific maximum value, dependent on the plot-specific offer.  Contact the Sales Advisor at the participating development for details of the applicable plots and the latest reservation date and legal completion date to which this offer can apply. This offer is only available in conjunction with any other offer at the sole discretion of CALA Homes. Vouchers are subject to confirmation of validity. Vouchers cannot be backdated, exchanged, or used as part payment.  Only one voucher per reservation. To receive the payment, purchasers must hand in the relevant promotional leaflet to a Sales Advisor at the development to which the incentive applies, on or before the date they reserve their home at that development.  The offer is only valid until the date stated on the leaflet and can only be used at the discretion of the CALA region to which the offer applies.

 

MULTIPLE INCENTIVES/OFFERS

Availability of other incentives or offers is subject to lender’s criteria and CALA’s discretion.   Our range of incentives are not all available in one purchase, they represent a selection of incentives and can only be used in conjunction with each other at CALA Homes’ discretion. Any offers will be available on selected plots at selected developments only.

 

RECOMMEND A FRIEND

Offer is subject to CALA’s purchasing criteria and terms and conditions for reservations of a new private tenure CALA home before the date stated on the promotional material. To claim your reward the voucher must be completed in full, signed by all parties and given to the CALA Representative on first visit. The reward(s) outlined will be paid to the person(s) stated on the voucher only upon legal completion of the homebuyer’s purchase. On legal completion a cheque payable to the person(s), to the agreed value will be issued. In the event of the completion not taking place for any reason the payment will not be honoured. Please allow four weeks after the completion date for receipt of the monies. Only one Recommend a Friend voucher can be used per home purchase. This scheme is not available to employees of CALA Homes, any person connected or related to such an employee, CALA Homes’ agents or any person either connected professionally with this scheme or offer or acting in a business capacity.

 

ASSISTED MOVE

Our “Assisted Move” service is only available on selected CALA homes subject to CALA’s discretion. We have the right to refuse your application for the Assisted Move service. We will only accept an Assisted Move reservation in the absence of a cash purchaser. Geographically, we will only consider an Assisted Move reservation if the sale of your existing property can be easily managed from a CALA regional office location. You agree to CALA appointing an estate agent to market and sell your existing property. Whilst we will consult with you, the terms of that appointment (including the choice of agent and the list price) will be at CALA’s discretion. You agree to allow the appointed agent to market your home and arrange viewings by appointment, at reasonable times. You agree not to instruct another agent during the period that your Assisted Move reservation is active and, if you have an existing contract with an agent, you agree you will dis-instruct that agent. CALA will not be liable for any related cancellation fees.

The buyer of your existing property must be able to exchange within a period of 28 days from the date their offer is accepted. If no acceptable offer is received within the temporary reservation period, we reserve the right to re-market our available plot. The Assisted Move service cannot be used with any other incentives or purchase services unless we specifically agree at the time of reservation. Agent fees, home report costs (where applicable) and the contribution to removal fees will be payable on legal completion of your new CALA home provided the sale of your existing property is achieved through the agent agreed by CALA and within the agreed timescales. 

 

 

ARMED FORCES DISCOUNT

The CALA Armed Forces Discount is offered on selected properties (at the discretion of CALA) to serving or retired members of the Regular and Reserve UK Armed Forces and those who have passed Phase 1 Training. A valid Ministry of Defence Form 90 ID card and proof of training status or Discharge Certificate must be presented in order to qualify. Only one Armed Forces Discount of 1.5% may be applied per home purchase. The discount is non-transferrable and cannot be converted into cash or used in conjunction with any other CALA offers.

The Help to Buy Equity Loan and Forces Help to Buy schemes are each subject to specific eligibility criteria which may be subject to change from time to time. Please note that the Forces Help to Buy scheme does not currently apply to Reserve UK Armed Forces members. SHOWHOME SALE & LEASEBACK SCHEME

CALA can only provide information about the buy-to-let opportunity and does not provide advice or make any recommendation in relation to any acquisition of a buy-to-let property. It is important that you understand the risks of investing in a buy-to-let property and CALA recommends that you get advice from a professional adviser before you commit to buying a property. Other than agreeing to enter into the sale and leaseback arrangement, CALA gives no guarantee of the future rental opportunity or yield in relation to the properties. It should be noted that the value of properties, the rental potential and income from properties is subject to general economic conditions and risks. 

 

CALA COMMUNITY BURSARY TERMS AND CONDITIONS

1. The CALA Community Bursary is organised by CALA Management Limited (hereinafter referred to as “CALA”), a limited liability company registered in Scotland with company registration number SC013655 and whose registered office is at Adam House, 5 Mid New Cultins, Edinburgh, EH11 4DU. 

2. The title of the funding initiative is CALA’s Community Bursary.

3. CALA’s Community Bursary invites charities, community groups and local organisations, in select geographical locations, to apply for a share of funding to support community projects in the areas in which CALA operates. 

4. The funding initiative will run from 00:00 on 3rd February 2020 (the “Opening Date”) to 23:59 on 6th March 2020 (the “Closing Date”) inclusive.

5. All funding entries must be received by CALA no later than 23:59 on the Closing Date. All funding entries received after the Closing Date are automatically disqualified, unless a deadline extension has been specified.

6. The Opening Date and the Closing Date are subject to change.

7. To enter the funding initiative:
a. Complete an entry form, which can be found at www.cala.co.uk/bursary by the Closing Date.
b. Request a printed entry form from your local CALA development. Send the completed entry form to the email stated, by the Closing Date.

8. There is no purchase necessary to enter the funding initiative.

9. CALA will not accept:
a. responsibility for funding entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
b. proof of posting or transmission as proof of receipt of entry to the funding initiative.

10. By submitting a funding entry, you are agreeing to be bound by these terms and conditions.

13. The funding entries will be judged by a panel of CALA employees. The decision of the panel (acting reasonably) will be final.

14. The funding initiative is only open to charities, community groups and organisations with a UK bank account registered in the name of the charity, community group or organisation making the entry submission and applications made on behalf of a charity, community group or organisation must be completed by a UK resident aged 18 years or over, except:
a. employees of CALA or its holding or subsidiary companies;
b. employees of agents or suppliers of CALA or its holding or subsidiary companies, who are professionally connected with the funding initiative or its administration;
c. members of the immediate families or households of (a) and (b) above; or,
d. any third party directly associated with administration of funding.

15. By applying for funding, you confirm that you are eligible to do so and eligible to claim any funds awarded. CALA may require you to provide proof that you are eligible to enter the funding initiative.

16. CALA will not accept funding entries that are:
a. automatically generated by computer;
b. completed by third parties or in bulk;
c. illegible, have been altered, reconstructed, forged or tampered with;
d. photocopies and not originals; or,
e. incomplete.

17. There is a limit of one entry to the funding per charity, community group or organisation.

18. CALA reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Bursary funding.

19. Entry forms cannot be returned.

20. The funding is not negotiable or transferable.

21. In order to claim the funds you must provide the organisation name payable and address.  

22. CALA will contact the applicant personally as soon as practicable after 30th April 2020 (the “Announcement Date”), using the telephone number or email address provided with the application form. CALA will not amend any contact information once the entry form has been submitted.

23. Successful applications will be required to participate in publicity related to the Community Bursary, which may include CALA either publishing or making available information that indicates the surname and county of successful applicants in any media, if consent is provided, after the Announcement Date.

24. If you object to any or all of your surname, county and winning entry being published or made available, please contact CALA by emailing cala.group@cala.co.uk. In such circumstances, the CALA must still provide the information and winning entry to the Advertising Standards Authority on request.

25. Funding may not be claimed by a third party on your behalf.

26. CALA will make all reasonable efforts to contact the successful applicants. If successful applicants cannot be contacted or are not available, or have not claimed their funding within 7 days of the Announcement Date, CALA reserves the right to offer the funding to the next eligible entrant selected from the correct entries that were received before the Closing Date.

27. CALA does not accept any responsibility if you are not able to take up the funding.

28. All application forms and any accompanying material submitted to the CALA will become the property of CALA on receipt and will not be returned.

29. By submitting your application form and any accompanying material, you agree to:
a. assign to CALA all your intellectual property rights with full title guarantee; and
b. waive all moral rights,
in and to your funding entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

30. CALA will only process your personal information as set out in the Privacy Policy.

31. If there is any reason to believe that there has been a breach of these terms and conditions, CALA may, at its sole discretion, reserve the right to exclude you from the Community Bursary.

32. CALA reserves the right to hold void, suspend, cancel, or amend funding where it becomes necessary to do so.

33. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

 

SUSTAINABILITY SURVEY COMPETITION

1. The prize draw is open to all UK residents aged 18 years or over, except employees of the CALA Management Limited (the Promoter) or any other CALA group company, their families, agents or any third party directly associated with administration of the prize draw.

2 The prize draw is free to enter and no purchase is necessary.

3. Only one entry per person is allowed (same name, same address, same email, same social media handle or same IP address).

4. The opening date for entries is 12:00 on 18th Feb 2020. The closing date of the prize draw is 17:00 on 29th Feb 2020. Entries received after this time will not be counted.

5. Dates, times and activities are subject to change.

6. CALA Management Limited as Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.

7. CALA reserves the right to verify the eligibility of entrants.

8. A winner will be selected at random from all eligible entries.

9. The winner will receive £100 John Lewis & Partners voucher.

10. The winner will be notified using details provided at entry by email and/or telephone and asked to provide CALA with their postal address for the prize to go to) and the prize will be delivered within 14 days of the winner being announced. If a winner does not respond to the Promoter within 24 hours of being notified by the Promoter, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

11.  The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.

12. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control make it necessary to do so.

13. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

14. The winner's name and county will be published on the CALA News pages of our website and on our social media channels (Facebook and Twitter).

15. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry.

16. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

17. The Promoter reserves the right to hold, void, cancel, suspend, or amend the promotion where it becomes necessary to do so.

18. CALA will treat personal data in accordance with current UK data protection legislation and will not disclose personally identifiable information to a third party without prior consent except in so far as set out in these terms and conditions and insofar as is required for the arrangement of the prize. 19. Non personal data provided by entrants will be used for the purposes of reviewing customer service standards and market understanding.

20. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
